Pursuant to the Direction of Election, an election.by secret ballot was conducted on March 27, 1941, under the direction and supervision ' of thei Regional Director for- the Thirteenth Region (Chicago, Illinois) : On March 31, 1941, the Regional Director, acting pursuant to Article -III, Section 9, of Na- tional Labor Relations Board Rules and'' Regulations-Series 2, as amended, issued and duly served upon the parties an Election Report on the ballot. As to the balloting and .its results, the Regional Director reported as follows : Total on eligibility list------------------------------------ 105 Total number of ballots cast------------------------------- 104 Total blank ballots---------------------------------------- 1 Total void ballots----------------------------------------- 1 Total valid votes cast-------------------------------------- 102 Votes cast for Bakery & Confectionery Workers' Interna- tional Union of America, Local 465----------------------- 58 Votes cast against Bakery & Confectionery Workers' Interna- tional Union of America Local 465------------------------ 44 On April 2, 1941, Chicago Macaroni Company, herein called the Company, filed Objections to Conduct of Ballot and Election Report. On May 29, 1941, the Regional Director issued a Report on Objections to Election Report, finding the Objections to be without merit. On June 3, 1941, the Company filed a memorandum pertaining to Report on Objections to Election Report. We have considered the Objections, the Regional Director's Report thereon, and the memorandum, and 130N L R B 288. 32 N. L. R. B, No. 89. 447 448 DECISIONS OF NATIONAL LABOR RELATIONS BOARD find that the Objections raise no substantial or material issues with respect to the conduct of the ballot. The Objections are hereby over- ruled. By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations- Series 2, as amended, IT Is HEREBY CERTIFIED that Bakery & Confectionery Workers' International Union of America, Local 465, has been designated and selected by a majority of all production and shipping employees of Chicago Macaroni Company, Chicago, Illinois, including whole- sale grocery division employees, but excluding clerical and supervisory employees, carpenters, professional die makers, engineers, firemen, electricians, truck drivers, truck drivers' helpers, watchmen, and porters, as their representative for,the purposes of collective bar- gaining, and that, pursuant to Section 9 (a) of the Act, Bakery & Confectionery Workers' International Union of America, Local 465, is the exclusive representative of all such employees for the purposes of collective bargaining with respect to rates of pay, wages, hours of employment,-and other conditions of employment.
