Case No. R-2445 SUPPLEMENTAL DECISION AND ORDER May 28, 19.¢1 On April 28, 1941, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election in the above-entitled proceeding.' Pursuant to the Direction of Election, an election by secret ballot was conducted on May 9, 1941, under the direction and supervision of the Regional Director for the Fifth Region (Baltimore, Maryland). On May 10, 1941, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued an Election Report, copies of which were duly served upon the parties. No objections to the conduct of the ballot or the Election Report have been filed by any of the parties. As to the balloting and the results thereof, the Regional Director reported as follows : Total number of employees eligible to vote__________________ 203 Total number of ballots cast_______________________________ 197 Total number of votes for United Textile Workers of America, American Federation of Labor___________________________ 88 Total number of votes against United Textile Workers of America, American Federation of Labor_________________ 104 Total number of Blank Ballots ___________________________ 0 Total number of Void Ballots____________________________ 0 Total number of Challenged Ballots__ ______________________ 5 The results of the election show that no collective bargaining representative has been selected by a majority of the employees of the Company in the unit heretofore found to be appropriate for col- 131 N. The petition for investigation and certification of representatives of the Company will therefore be dismissed. ORDER By virtue of Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, the National Labor Relations Board hereby orders that the peti- tion for investigation and certification of representatives of employees of Lexington Silk Mills Division of Burlington Mills Corporation, Lexington, North Carolina, filed herein be, and it hereby is, dismissed.
