The Direction of Election pro- vided that an election by secret ballot be conducted within twenty (20) days from the date of the Direction among the hourly paid production workers and yardmen of Armour & Company, West Fargo, North Dakota, who were on the pay roll of the company during the week ending October 30, 1937, excluding supervisory and clerical employees, temporary workers, plant clean- ers, police and watchmen, chemists, plant and storeroom clerks, mes- sengers, truck drivers, and those who had since quit or been dis- charged for cause, to determine whether they desired to be repre- sented by the Amalgamated Meat Cutters and Butcher Workmen of North America, Local Union No. 413, or the Independent Workers Alliance, for the purposes of collective bargaining, or by neither. Pursuant to the Direction, an election by secret ballot was con- ducted on April 1, 1938. Full opportunity was accorded to all the parties to this investigation to participate in the conduct of the secret ballot and to make challenges. Thereafter, Robert J. Wiener, Acting Regional Director for the Eighteenth Region (Minneapolis, Minne- sota ), acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 1, as amended, issued and duly served upon the parties an Intermediate Report on the election. No objections or exceptions to the Intermediate Report have been filed by any of the parties. 15 N. L. R B. 975. 530 DECISIONS AND ORDERS 531 As to the balloting and its results, the Regional Director reported as follows : Total number eligible to vote -------------------------------- 386 Total number of ballots cast-------------------------------- 308 Total number of votes in favor of Amalgamated Meat Cutters and Butcher Workmen of North America, Local Union No. 413------------------------------------------------------ 203 Total number of votes in favor of Independent Workers Alliance-------------------------------------------------- 97 Total number of votes in favor of neither organization ------ 7 Total number of blank ballots------------------------------- 1 Total number of void ballots -------------------------------- 0 Total number of challenged ballots -------------------------- 0 By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 1, as amended, IT IS HEREBY CERTIFIED that Amalgamated Meat Cutters and Butcher Workmen of North America, Local Union No. 413, has been designated and selected by a majority of hourly paid production workers and yardlnen of Armour & Company, West Fargo, North Dakota, excluding supervisory and office employees, temporary work- ers, plant cleaners, police and watchmen, chemists, plant and store- room clerks, messengers, and truck drivers, as their representative for the purposes of collective bargaining, and that, pursuant to Sec- tion 9 (a) of the National Labor Relations Act, Amalgamated Meat Cutters and Butcher Workmen of North America, Local Union No. 413, is the exclusive representative of all such employees for the pur- poses of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment.
