Zandri Construction v. Calkins, Firemen's Insurance

Court of Appeals of the State of New York
Oct 29, 1981
54 N.Y.2d 999 (N.Y. 1981)

Opinion

Decided October 29, 1981

Appeal from the Appellate Division of the Supreme Court in the Third Judicial Department, DANIEL H. PRIOR, JR., J.

Leslie F. Couch for appellant.

Dale M. Thuillez for Firemen's Insurance Co. of Newark, respondent.

Peter A. Firth for Lumbermen's Mutual Casualty Co., respondent.

On summary consideration, order affirmed, with costs. Plaintiff's claims under the insurance policies fall within the policies' exclusions and defendant insurance companies are relieved of their obligations to defend and indemnify. The exception to the exclusion for contractual liability when read in conjunction with the other policy exclusions does not lead to a contrary result.

Concur: Chief Judge COOKE and Judges JASEN, GABRIELLI, JONES, WACHTLER, FUCHSBERG and MEYER.
