Opinion

No. 118435.

01-28-2015

Jeffrey D. WOODS, respondent, v. ROCK FUSCO, L.L.C. (John J. Rock, petitioner).

Opinion

Petition for leave to appeal denied.

In the exercise of this Court's supervisory authority, the Appellate Court, First District, is directed to vacate so much of its judgment in Woods v. Rock Fusco, L.L.C, case No. 1–13–1900, 2014 WL 4929458 (09/30/14), as declined to consider on the basis of waiver defendant John Rock's argument that plaintiff failed to prove a causal connection between defendant John Rock's actions and plaintiff's injuries. (Slip op. ¶¶ 114–15). The appellate court is directed to ignore any element of waiver and to address the issue on its merits, and it may give the parties an additional opportunity to respond to the merits.
