Appeal pursuant to N.C.G.S. § 7A-30(2) from the decision of a divided panel of the Court of Appeals, ___ N.C. App. ___, 682 S.E.2d 435 (2009), affirming a judgment entered on 10 June 2008 by Judge Howard E. Manning, Jr. in Superior Court, Durham County. Heard in the Supreme Court 16 February 2010.
