Judgment of the Municipal Court reversed and new trial ordered, costs to abide the event, on the authority of Barnett v. Brooklyn Heights R.R. Co. ( 53 App. Div. 432) and People v. Brooklyn Heights R.R. Co. ( 187 N.Y. 48). Jenks, Hooker, Gaynor, Rich and Miller, JJ., concurred.
