ORDER


After making an independent review of the pleadings, files and records in this case, and the findings, conclusions and recommendation of the United States Magistrate Judge, filed on May 1, 2003, the court determines that the findings and conclusions of the United States Magistrate Judge are correct. The findings and conclusions of the United States Magistrate Judge are hereby accepted as those of the court. Accordingly, Plaintiff may prosecute his medical care claims against Nurse L. Connell and Patrick Jones; Plaintiff's claim against Warden Herrera and Warden Webb are severed from this action and transferred to the Tyler Division of the Eastern District of Texas pursuant to 28 U.S.C. § 1404 (a); and all other claims are hereby dismissed with prejudice as frivolous. The clerk of the court is directed to issue summons, and the United States Marshal's Service shall serve process on Nurse L. Connell and Patrick Jones.

It is so ordered.
