Appeals — Review — Chancellor's fact findings.

A chancellor's findings of fact supported by substantial evidence and confirmed by the court in banc have the weight of a jury verdict.

Before JONES, C. J., BELL, CHIDSEY, MUSMANNO, ARNOLD, JONES and COHEN, JJ.

Appeal, No. 379, Jan. T., 1957, from decree of Court of Common Pleas of Lancaster County, in equity, Docket No. 11, in case of John W. Willwerth et al. v. Parke C. Dunlap et al. Decree affirmed.

Equity. Before JOHNSTONE, J.

Adjudication entered dismissing the complaint; plaintiffs' exceptions dismissed and final decree entered. Plaintiffs appealed.

The chancellor's findings of fact are supported by the evidence, and, having been confirmed by the court en banc on exceptions, have the weight of a jury's verdict. The conclusions of law which the chancellor correctly applied to the established facts, fully justify the final decree entered.

Decree affirmed at appellants' costs.
