Order so far as appealed from reversed, with twenty dollars costs and disbursements, and motion granted in so far as to dismiss the first cause of action, with leave to the plaintiff to serve an amended complaint within twenty days from service of order upon payment of said costs. (See Finsilver v. Still, 240 App. Div. 87.)
