Waterbury, 95-1238 (La.App. 3 Cir. 5/8/96), 674 So.2d 1128, the judgment of the trial court is affirmed in part, reversed in part and rendered. All costs of this consolidated appeal are assessed against appellee.

AFFIRMED IN PART; REVERSED IN PART AND RENDERED.
