IN HABEAS CORPUS.

Mr. Howard J. Ware, in propria persona. Mr. William B. Saxbe, attorney general, and Mr. William C. Baird, for respondent.


This is an action in habeas corpus originating in this court. The sentence having expired and petitioner having been released from custody, the case is moot and habeas corpus does not lie.

The motion to dismiss the petition is sustained, and the petition is dismissed.

Motion sustained and petition dismissed.
