Appeal from a judgment of the Supreme Court, Suffolk County, dated July 22, 2019. Motion by the appellant for this Court to take judicial notice of a decision and order of this Court dated December 2, 2020, which determined the appeal in Matter of Labate v DeChance (189 A.D.3d 838), and an opinion of the Appellate Term of the Supreme Court for the Ninth and Tenth Judicial Districts in People v Vanderveer (71 Misc.3d 133[A]).
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
