Argued May 15, 1934 —

Decided October 5, 1934.

On appeal from a judgment of the Essex County Circuit Court.

The judges being equally divided on the question whether the judgment should be reversed, the judgment is affirmed, solely because of such division, which renders any opinion by the court impossible.

For the appellant, Brenner Kresch.

For the respondent, McDermott, Enright Carpenter.


The judgment under review is affirmed, by an equally divided court.
