         OPINION

          CROCKER, Judge

         On petition for rehearing, Sawyer, J. delivered the opinion of the Court. Sanderson, C. J., Shafter, J., and Rhodes, J. concurring.

         We are satisfied, upon examination of the record, that Grimm, the intervenor, had no right, as mortgagee, to intervene in the proceeding in the Court below, for the reasons stated in the opinion of Justice Crocker.

         Upon this ground, the petition for rehearing is denied.
