ORDER


THIS MATTER is before the Court on the Cross-Motions for Summary Judgment filed by Plaintiff Travelers Indemnity Company of America and Defendants Wal-Mart Stores, Inc. and I.E. Ventures, LLC ("Defendants"). For the reasons stated in the accompanying Memorandum, Plaintiffs Motion is DENIED and Defendants' Motions are GRANTED. The Court hereby DECLARES that the damages sought against Defendant Miller Building Corporation in the case styled Wal-Mart Stores. Inc. et al. v. Miller Building Corporation, et al. At Law No. CL 2000-691 (Circuit Court of Chesterfield County), are COVERED under Plaintiffs Commercial General Liability insurance policies.

Let the Clerk send a copy of this Order to all parties of record.

It is SO ORDERED.
