HIGHWAYS AND STREETS, § 267highway commissioner, liability for sale of road grader. Where highway commissioner sold a road grader for $1,100, and vendee after making repairs sold the grader to another township for $2,800, in action by first town against the highway commissioner for the difference between the two sums, lower court did not err in finding that $1,100 represented the market value of the grader without repair.

Appeal from Circuit Court of St. Clair county; Hon. MAURICE V. JOYCE, presiding.

Affirmed. Heard in this court at February term, 1940.
