DAVID TITSHAW et al. v. WILL B. GEER et al.

The Honorable Supreme Court met pursuant to adjournment. The following order was passed:

Court of Appeals Case No. A23A0410

The Supreme Court today granted the writ of certiorari in this case as case no. S23G1124 .

This case will be assigned to the April 2024 oral argument calendar automatically under Supreme Court Rule 50 (1) (a). Oral argument is mandatory in granted certiorari cases.

This Court is particularly concerned with the following issue or issues:

1. Did the Court of Appeals err in determining that because the claims for breach of contract are based upon the same conduct as the legal malpractice claim, the breach of contract claims are governed by the same statute of limitations as the legal malpractice claim?
2. What statute of limitations governs a claim for the breach of a contract for legal services? Compare Cuffie v. Armstrong, 311 Ga. 791 (860 S.E.2d 504) (2021) with
Newell Recycling of Atlanta, Inc. v. Jordan Jones and Goulding, Inc., 288 Ga. 236 (703 S.E.2d 323) (2010).

Briefs should be submitted only on these points. See Supreme Court Rule 45.

All the Justices concur.

I certify that the above is a true extract from the minutes of the Supreme Court of Georgia.

Witness my signature and the seal of said court hereto affixed the day and year last above written.
