Court of Errors and Appeals
Oct 5, 1934
113 N.J.L. 514 (N.J. 1934)

Opinion

Submitted May 25, 1934 —

Decided October 5, 1934.

On appeal from a judgment of the Supreme Court, whose per curiam opinion is printed in 11 N.J. Mis. R. 857.

The judges being equally divided on the question whether the judgment should be reversed, the judgment is affirmed, solely because of such division, which renders any opinion by the court impossible.

For the appellants, Cohn Kohlreiter.

For the respondent, Feder Rinzler.

The judgment under review is affirmed, by an equally divided court.

For affirmance — TRENCHARD, CASE, BODINE, DONGES, DEAR, WELLS, JJ. 6.

For reversal — THE CHANCELLOR, CHIEF JUSTICE, HEHER, VAN BUSKIRK, KAYS, HETFIELD, JJ. 6.
