ORDER and JUDGMENT


The court has before it this Standing Order 30 recommendation by the Magistrate Judge that Plaintiffs' First Amended Complaint should be dismissed and Defendant SGS Control Services, Inc.'s remaining motions (18, 42, 86) should be dismissed as moot. The Plaintiffs timely objected to the recommendation and Defendant SGS timely responded.

The record, including the Plaintiffs' objections and Defendant SGS's response, has been reviewed by this court, and it is the opinion of this court that the recommendation is in accord with the facts and the prevailing law. The court adopts the recommendation of the Magistrate Judge entered on June 3, 2004, as its own findings and conclusions.

IT IS THEREFORE ORDERED that Defendant SGS' Motion to Dismiss Plaintiffs' First Amended Complaint (Doc. No. 84) is hereby dismissed.

IT IS FURTHER ORDERED that Plaintiffs' motions (Doc. Nos. 92 and 94) are denied as moot.

IT IS FURTHER ORDERED that the Defendant's remaining motions (Doc. Nos. 18, 42, 86) are denied as moot.

IT IS FURTHER ORDERED AND ADJUDGED that this proceeding is hereby dismissed.
