Sullivan v. Travelers Ins. Co.

Court of Appeal of Louisiana, First Circuit
Jun 4, 1957
95 So. 2d 834 (La. Ct. App. 1957)

Opinion

No. 4433.

June 4, 1957.

Appeal from Fourteenth Judicial District Court, Parish of Calcasieu; Preston L. Savoy, Judge.

Bass Nichols, Lake Charles, for appellant.

Lawes, Cavanaugh, Hickman Brame, Lake Charles, for appellees.

This workmen's compensation suit by a longshoreman injured while working on a vessel in navigable waters involves the same legal question as that involved in Richard v. Lake Charles Stevedores, Inc., La.App., 95 So.2d 830. For the reasons assigned in that case, the District Court judgment herein sustaining defendant's exceptions and dismissing plaintiff's action is reversed, and this suit is remanded for further proceedings according to law.

Reversed and remanded.
