MEMORANDUM ORDER


The Court has reviewed thoroughly plaintiff's motion for reconsideration of the Court's Opinion and Order dated March 29, 2002 (the "Opinion") and supporting documents, and the letter submitted by defendants 866 3rd Next Generation LLC and Courtyard Management Corp. in opposition thereto.

A motion for reconsideration can be granted if there is an intervening change of controlling law, new evidence becomes available, or if there is a need to correct a clear error or prevent manifest injustice. Virgin Atlantic Airways v. Nat'l Mediation Bd., 956 F.2d 1245, 1255 (2d Cir. 1992) (citation omitted). See also Fed.R.Civ.P. 60(b), S.D.N.Y. Local Civil Rule 6.3.

Plaintiff has failed to show a legal or factual basis justifying reconsideration of the Opinion. Accordingly, for these reasons and for the reasons set forth in the Opinion, plaintiff's motion for reconsideration is denied.
