Stewart v. State

Supreme Court of Florida.
Mar 16, 2015
163 So. 3d 514 (Fla. 2015)

Opinion

No. SC13–1234.

03-16-2015

Kenneth Allen STEWART, Appellant(s), v. STATE of Florida, Appellee(s).

Opinion

We affirm the trial court's order dismissing Stewart's successive postconviction motion. See Fla. R.Crim. P. 3.851(d). Ineffective assistance of postconviction counsel claims are not cognizable under Florida law. Kormondy v. State, 154 So.3d 341, 354 (Fla.2015). Moreover, the United States Supreme Court's decision in Martinez v. Ryan, 132 S.Ct. 1309 (2012), “does not provide an independent basis for relief in state court proceedings.” Banks v. State, 150 So.3d 797, 800 (Fla.2014).

LABARGA, C.J., and PARIENTE, LEWIS, CANADY, POLSTON, and PERRY, JJ., concur.

QUINCE, J., recused.
