The defendant's petition for certification for appeal from the Appellate Court, 58 Conn. App. 816 (AC 17664), is granted, limited to the following issue:

"Should State v. Malave, 250 Conn. 722, 737 A.2d 442 (1999), cert. denied, 528 U.S. 1170, 120 S.Ct. 1195, 145 L.Ed.2d 1099 (2000) (abandonment of Secondino v. New Haven Gas Co., 147 Conn. 672, 165 A.2d 598 rule) be applied retroactively?"

NORCOTT, J., did not participate in the consideration or decision of this petition.

The Supreme Court docket number is SC 16401.
