In re: Albert Williams, III, applying for Writ of Review, Certiorari, Prohibition or Mandamus.


Writ denied. The ruling of the trial court denying bail in this instance is correct.

BARHAM, J., is of the opinion that since aggravated rape is no longer punishable by death under the old law and since the legislature considered whether to impose death in such a case in the last session and rejected it — the crime is not capital and bail may be had. See dissent in State v. Rhymes, La., 284 So.2d 923.
