STATE of Connecticut v. Jeffrey SMITH

Adele V. Patterson, senior assistant public defender, in support of the petition. Melissa Patterson, assistant state's attorney, in opposition.


The defendant's petition for certification to appeal from the Appellate Court, 180 Conn.App. 371, 184 A.3d 831 (2018), is granted, limited to the following issue:

"Does this court's holding in State v. Polanco, 308 Conn. 242, 61 A.3d 1084 (2013), readopting vacatur as a remedy for a cumulative conviction that violates double jeopardy protections, apply retroactively?"
