The Supreme Court of Washington. En Banc
Apr 26, 1973
508 P.2d 1028 (Wash. 1973)

Opinion

No. 42634.

April 26, 1973.

Review of a decision of the Court of Appeals, September 5, 1972, 7 Wn. App. 527. Affirmed.

The Court of Appeals affirmed in part and reversed in part a judgment of the Superior Court for Pierce County, No. 39649, Robert A. Jacques, J., entered February 5, 1971. Appellants (defendants) petitioned the Supreme Court for review.

Prosecution for unlawful assembly and for failure to disperse. Defendants appealed to the Court of Appeals from convictions and sentences.

Koenigsberg, Brown, Sinsheimer, Stone Meltzer, Ronald J. Meltzer, and Robert Czeisler, for petitioners.

Ronald L. Hendry, Prosecuting Attorney, Joseph D. Mladinov, Special Counsel, and Eugene G. Olson, Chief Criminal Deputy, for respondent.

After hearing the argument of counsel and fully considering the entire record, we find the Court of Appeals was correct in State v. Johnson, 7 Wn. App. 527, 500 P.2d 788 (1972). The opinion therein states the facts, correctly sets forth the applicable law and is hereby approved and adopted as the opinion of this court.

HALE, C.J., FINLEY, ROSELLINI, HUNTER, HAMILTON, STAFFORD, UTTER, and BRACHTENBACH, JJ., concur.
