State v. Jettinghoff

District Court of Appeal of Florida, Fourth District
Oct 13, 1999
743 So. 2d 601 (Fla. Dist. Ct. App. 1999)

Opinion

No. 99-0208.

Opinion filed October 13, 1999.

Appeal from the Circuit Court for the Fifteenth Judicial Circuit, Palm Beach County; Marvin U. Mounts, Jr., Judge; L.T. No. 98-10095 CFA02.

Robert A. Butterworth, Attorney General, Tallahassee, and Gentry Denise Benjamin, Assistant Attorney General, West Palm Beach, for appellant.

Richard L. Jorandby, Public Defender, and Ian Seldin, Assistant Public Defender, West Palm Beach, for appellee.

We reverse the trial court's dismissal of appellee's felony DUI charges, and remand for further proceedings, on authority of State v. Swartz, 734 So.2d 448 (Fla. 4th DCA 1999). In Swartz we rejected both arguments appellee now raises regarding the circuit court's jurisdiction over a felony DUI charge and the remoteness of prior DUI convictions. See id. at 449.

POLEN, GROSS and TAYLOR, JJ., concur.
