MOTION AND PROCEDURAL RULINGS.

Upon consideration of the jurisdictional memoranda filed in this case, the court accepted the appeal on Proposition of Law Nos. I and II and the cross-appeal on Proposition of Law No. IV and held the cause for a decision in 2006-0151, State v. Carswell, Warren App. No. CA2005-04-047, 2005-Ohio-6547.

It is ordered by the court, sua sponte, that briefing shall proceed in the appeal on Proposition of Law Nos. I and II.

The Clerk shall issue an order for the transmittal of the record from the Court of Appeals for Cuyahoga County, and the parties shall brief this case in accordance with the Rules of Practice of the Supreme Court of Ohio.
