Motion and Procedural Rulings

On review of order certifying a conflict. The court determines that a conflict exists. The parties are to brief the issue stated at page 2 of the court of appeals' Decision and Entry filed January 29, 2007:

"Does a trial court have authority, generally, to order that a felony sentence imposed by it be served consecutively with a felony sentence previously imposed by another Ohio court?"

O'DONNELL and LANZINGER, JJ., dissent.

The conflict case is State v. Thompson, Fairfield App. No. 01CA62, 2002-Ohio-4717.

Sua sponte, cause consolidated with 2007-0293, State v. Bates, Miami App. No. 06-CA-08, 2006-Ohio-7086. Michael R. Gladman of Columbus, Ohio, is appointed to represent appellant on a pro bono basis.
