Application filed in the supreme court March 28, 1931, for a writ of mandamus to compel the secretary of state to receive and file a petition for the referendum of chapter 140, Laws of 1931.

The court is of the opinion that the issues here presented are identical with the issues involved in the case of State ex rel. Reiter v. Hinkle, 161 Wn. 652, 297 P. 1071, and that the decision of the court in that case is controlling here.

The writ is therefore denied, and the action is dismissed.
