Spellman v. Spellman

Court of Appeals of Maryland
Nov 22, 1935
182 A. 342 (Md. 1935)

Opinion

[Nos. 17, 18, October Term, 1935.]

Decided November 22d 1935.

Divorce — For Adultery — Alimony Pendente Lite.

The allowance of alimony and the amount thereof are in the sound discretion of the chancellor, and his action thereon will not be disturbed unless there is an apparent abuse of that discretion.

An allowance to the wife of alimony pendente lite in the amount of four dollars per month held insufficient, and increased to fifteen dollars per week.

A decree of divorce for the wife's adultery held to be supported by the evidence.

Decided November 22d 1935.

Appeal from the Circuit Court of Baltimore City (ULMAN, J.).

Bill by Howard C. Spellman against Margaret Spellman, for a divorce. From a decree granting a divorce, and from an order fixing the amount of alimony pendente lite and appellant's counsel fee, the defendant appeals. Decree affirmed, and order reversed in part and affirmed in part.

The cause was argued before BOND, C.J., URNER, OFFUTT, PARKE, SLOAN, MITCHELL, SHEHAN, and JOHNSON, JJ.

William T. Tippett, with whom was James E. Tippett on the brief, for the appellant.

Lester L. Barrett, with whom was Joshua S. Hull on the brief, for the appellee.
