ORDER DISMISSING PLAINTIFFS' COMPLAINT


On August 22, 2003, the court issued an order denying plaintiffs' request that is set aside the Bureau of Land Management's ("BLM") decision. Soon after, on October 21, 2003, plaintiffs filed a Notice of Appeal with the Tenth Circuit. In its decision dated November 12, 2004, the Tenth Circuit held that the appeal had become moot.

Upon reaching its holding, the Tenth Circuit dismissed the appeal and remanded the case to this court with direction that it vacate its order a judgment of August 22, 2003, and dismiss plaintiffs' complaint. SO ORDERED. The clerk of the court is directed to close the case.
