          Appeal pursuant to N.C.G.S. § 7A-30(2) from the decision of a divided panel of the Court of Appeals, __ N.C.App. __, 664 S.E.2d 388 (2008), affirming in part and remanding in part a judgment entered on 5 April 2007 by Judge William C. McIlwain in District Court, Scotland County.
