Opinion

Gen. No. 43,647. (Abstract of Decision.)

Opinion filed May 20, 1947 Rehearing denied June 4, 1947 Released for publication June 9, 1947

DAMAGES, § 267exemplary damages, award as disproportionate to actual damages. Jury award for exemplary damages of almost seven times amount of loss alleged to have been sustained by plaintiff was so disproportionate thereto as to require reversal of judgment, in tort action charging obtention of satisfaction of judgment for less than amount due by means of fraudulent conspiracy, wherein plaintiff requested exemplary damages on theory that he had been put to considerable expense in collecting that judgment.

See Callaghan's Illinois Digest, same topic and section number.
