Rossi v. First National City Bank

Court of Appeals of the State of New York
Feb 13, 1986
490 N.E.2d 1218 (N.Y. 1986)

Opinion

Decided February 13, 1986

Appeal dismissed, without costs, by the Court of Appeals sua sponte, upon the ground that the order of the Appellate Division insofar as it affirmed the denial of plaintiff's motion to vacate a default judgment does not finally determine the action within the meaning of the Constitution, and upon the ground that, as to the remainder of the order of the Appellate Division, no substantial constitutional question is directly involved.
