Steven ROBLES, Appellant v. The STATE of Texas, Appellee

From the 144th Judicial District Court, Bexar County, Texas Trial Court No. CM103494 Honorable Michael E. Mery, Judge Presiding

ORDER

Liza A. Rodriguez, Justice

Appellant has filed a notice of appeal, stating he is challenging an interlocutory ruling of the trial court. We generally do not have jurisdiction to consider an appeal in a criminal case unless a judgment of conviction has been rendered. See McKown v. State, 915 S.W.2d 160, 161 (Tex. App.-Fort Worth 1996, no pet.). We do not have jurisdiction to review interlocutory orders unless that jurisdiction has been expressly granted by law. See Apolinar v. State, 820 S.W.2d 792, 794 (Tex. Crim. App. 1991); see also Williams v. State, 464 S.W.2d 842, 844 (Tex. Crim. App. 1971) (noting that an order on a motion to dismiss an indictment is reviewable on appeal after conviction).

It appears from the clerk's record that we do not have jurisdiction over this appeal. See Williams, 464 S.W.2d at 844; Keller v. State, 760 S.W.2d 816, 817 (Tex. App.-Corpus Christi 1988, no pet.). We therefore ORDER appellant to show cause on or before March 9, 2023 why this appeal should not be dismissed for lack of jurisdiction. All appellate deadlines are suspended pending further order of this court.

IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of the said court on this 23rd day of February, 2023.
