Appeal and error — appealable order.

Appeal by plaintiff from an order of the district court for Ramsey county, Arthur A. Stewart, Judge, granting the motion of defendant Minnesota Homes, Inc., for an order declaring a notice of lis pendens filed with the register of deeds of Dakota county illegal and of no effect and ordering said notice cancelled and expunged from the record. Motion of Minnesota Homes, Inc., to dismiss appeal denied.

The motion of the respondent, Minnesota Homes, Inc., to dismiss the plaintiff's appeal is denied, on the ground that the order cancelling a notice of lis pendens is appealable under the provisions of M.S.A. 605.09(2).
