Interlocutory judgment affirmed, with costs, upon opinion of Kruse, J., delivered at Special Term (reported sub nom. Rose v. Northrup in 41 Misc. Rep. 238), with leave to defendant to plead over upon payment of costs of the demurrer and of this appeal. All concurred, except Williams, J., dissenting.
