ORDER


AND NOW, this 30th day of November, 2004, after the plaintiff, Reese Brothers, Inc., submitted a Motion for Summary Judgment, and after a Motion for Summary Judgment was submitted by defendant, United States of America, and after a Report and Recommendation was filed by the United States Magistrate Judge granting the parties ten days after being served with a copy to file written objections thereto, and upon consideration of the objections filed by defendant, and the response to those objections filed by plaintiff, and upon independent review of the motion and the record, and upon consideration of the Magistrate Judge's Report and Recommendation, which is adopted as the opinion of this Court,

IT IS ORDERED that plaintiff's Motion for Summary Judgment [Docket No. 7] is granted; and the defendant's Motion for Summary Judgment [Docket No. 14] is denied.

IT IS FURTHER ORDERED that final judgment of this Court is entered pursuant to Rule 58 of the Federal Rules of Civil Procedure.
