Appeal from an order granting respondent's motion for consolidation of a summary proceeding with an action for specific performance. In view of the decision in Rabinovitz v. Williamson ( ante, p. 841, decided herewith), the appeal is dismissed as academic, without costs. Nolan, P.J., Carswell, Adel, Sneed and Wenzel, JJ., concur. [ 192 Misc. 975.]
