Platt v. Tenenbaum

Court of Appeals of the State of New York
May 20, 1965
209 N.E.2d 110 (N.Y. 1965)

Opinion

Submitted May 17, 1965

Decided May 20, 1965

Appeal from the Appellate Division of the Supreme Court in the First Judicial Department, THOMAS A. AURELIO, J.

Max Toberoff for motion.

Lewis I. Wolf and Emanuel Morgenbesser opposed.

Motion dismissed, with $10 costs, upon the ground that the order sought to be appealed from does not finally determine the action within the meaning of the Constitution and, in addition, involves nonreviewable discretion ( Keller v. United States Lines, 15 N.Y.2d 908).
