In a coram nobis proceeding, defendant appeals from an order of the County Court, Nassau County, dated March 31, 1970, which denied the application without a hearing. Order affirmed. In our view the rationale of People v. Couse ( 34 A.D.2d 859) is applicable. Rabin, Acting P.J., Munder, Martuscello, Latham and Benjamin, JJ., concur.
