Rule 23 Order No. 1-04-2171.
Disposition of Petitions for Leave to Appeal Denied with order.
In the exercise of this court's supervisory authority, the Appellate Court, First District, is directed to vacate its order in People v. Malek, No. 1-04-2171 (June 8, 2007), and to retain jurisdiction and remand to the circuit court for a suppression hearing. If the outcome of the hearing so requires, a new trial should be held. If the outcome of the hearing does not require a new trial, the defendant's conviction should be affirmed.
