Summary Dispositions October 29, 1996:

In lieu of granting leave to appeal, the Court of Appeals judgment of November 17, 1995, is vacated, and the case is remanded to that Court for it, while retaining jurisdiction, to remand to the trial court for an evidentiary hearing as proposed in the dissenting opinion in the Court of Appeals. MCR 7.302(F)(1). The Court of Appeals is to thereafter reconsider this issue. Jurisdiction is not retained.
