On order of the Court, the application for leave to appeal from the February 6, 2001 decision of the Court of Appeals is considered, and it is GRANTED. In addition to the issue raised by the application, the parties shall brief the issue of whether the inference upon inference rule of People v Atley, 392 Mich. 298 (1974), was violated under the facts of this case, and whether that decision should be overruled.

Cavanagh and Kelly, JJ., would deny leave to appeal.
