Appeal by the People from an order of the Supreme Court, Richmond County, dated March 28, 1969, which, upon defendant's motion, dismissed the indictment. Order affirmed, upon the opinion of Mr. Justice KOOTA at the Criminal Term ( People v. Haney, 59 Misc.2d 162; see, also, People v. Taylor, 31 A.D.2d 852; People v. Blair, 33 A.D.2d 1100).
