Concur: Chief Judge DESMOND and Judges VAN VOORHIS, BURKE, SCILEPPI and KEATING. Judges FULD and BERGAN dissent and vote to reverse and to dismiss the indictment upon the ground that defendant's guilt was not established beyond a reasonable doubt.
