People v. Cadorette

Court of Appeals of the State of New York
Jun 23, 1982
56 N.Y.2d 1007 (N.Y. 1982)

Opinion

Argued June 7, 1982

Decided June 23, 1982

Appeal from the Appellate Division of the Supreme Court in the Second Judicial Department, PASQUALE E. DI VERNIERI, J.

Darren O'Connor and William E. Hellerstein for appellant.

Thomas R. Sullivan, District Attorney ( George E. McVay and Anthony L. Galante of counsel), for respondent.

MEMORANDUM.

The order of the Appellate Division should be affirmed.

Our review of the record reveals that the evidence presented at trial is sufficient to support defendant's conviction for attempted murder. Defendant's other contention regarding alleged errors in the trial court's charge to the jury has not been preserved for our review insofar as no exception to the charge was taken at trial ( People v Thomas, 50 N.Y.2d 467).

Chief Judge COOKE and Judges JASEN, GABRIELLI, JONES, WACHTLER, FUCHSBERG and MEYER concur.

Order affirmed in a memorandum
