Appellate Division of the Supreme Court of New York, Second Department
Apr 21, 1958
5 A.D.2d 1005 (N.Y. App. Div. 1958)

Opinion

April 21, 1958

Appeal from a judgment of the County Court, Kings County, convicting appellant, after trial, of manslaughter in the first degree and sentencing him to serve from 10 to 20 years. Judgment reversed on the facts and a new trial ordered. In our opinion the verdict was contrary to the weight of the credible evidence. Nolan, P.J., Wenzel, Beldock, Ughetta and Hallinan, JJ., concur.
